Terms of Service

These Terms of Service ("Terms") govern your use of the Petalwise mobile application (the "App") provided by Petalwise ("we", "our", or "us"). By using the App, you agree to these Terms.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information when creating an account.

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract source code from the App, except where allowed by applicable law.
• Interfere with or disrupt the App's servers or networks.
• Submit content that is illegal, harmful, or infringes on others' rights.
• Use the App to harass, abuse, or harm another person.

AI Features and Plant Care Disclaimer

The App uses AI to identify plants and assess their health from photos. AI output may be inaccurate. The plant identification, watering schedules, health diagnoses, and care recommendations provided by the App are for informational purposes only and are not a substitute for professional horticultural or veterinary advice.

• We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content.
• Do not rely on the App for treatment of toxic exposure, allergic reactions, or any health emergency involving humans, pets, or plants.
• You are solely responsible for the care of your plants.

Bring Your Own Key

If you choose to use your own API key for a third-party AI provider, you are responsible for:

• Complying with that provider's terms of service.
• Any fees or charges imposed by that provider.
• The confidentiality of your API key.

Subscriptions and Payments

The App may offer paid features in the future. If so, additional terms specific to those purchases will apply.

Intellectual Property

The App, including its content, design, and code, is owned by Petalwise and protected by copyright and other intellectual property laws. You retain ownership of plant photos and other content you create within the App.

Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the App at any time by signing out and uninstalling it.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETALWISE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date and, where appropriate, notice within the App.

Governing Law

These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-law principles.
